These Terms and Conditions ("Terms") constitute a legally binding agreement ("Agreement") between you and UrbanGlide Technologies Inc. ("UrbanGlide", "we", "us", or "our") governing your use of our electric scooter rental services, our mobile application ("App"), and our website (collectively, the "Services").

1. General Rental and Use of Scooters

Rider is Sole Operator: You and UrbanGlide are the only parties to this Agreement. You are the sole renter and are solely responsible for compliance with all terms and conditions contained herein. You understand that when you activate a Scooter from the location, the Scooter must be used only by you.

Rider is At Least 18 Years Old: You represent and certify that you are at least 18 years old. Operation of the Scooter is prohibited by persons under the age of 18.

Competency to Operate Scooter: You represent and certify that you are familiar with the operation of the Scooter, and are reasonably competent and physically fit to ride the Scooter. You are responsible for determining whether conditions, including, without limitation, rain, fog, snow, hail, ice, heat or electrical storms, make it dangerous to operate a Scooter.

Prohibited Acts: You agree that you will not:

• Operate any Scooter in violation of any applicable laws or regulations.
• Operate a Scooter while carrying any briefcase, backpack, bag, or other item if it impedes your ability to safely operate the Scooter.
• Use any cellular telephone, text messaging device, portable music player, or other device that may distract you from operating the Scooter safely.
• Operate a Scooter while under the influence of any alcohol, drugs, medication, or other substance that may impair your ability to operate a Scooter safely.
• Carry a second person or a child on a Scooter.
• Park any Scooter in a manner that is not compliant with all applicable laws, or in a location that obstructs pedestrian or vehicle traffic.

2. Payment and Fees

Fees: You may use the Services on a pay-per-ride basis or as otherwise described in the App. The applicable fees will be displayed in the App. All fees are non-refundable and subject to change.

Payment Method: You must provide a valid credit or debit card number and expiration date or other valid payment method information. You represent and warrant that you are authorized to use any payment method you provide. You authorize us to charge the provided payment method for all fees you incur.

Fines and Penalties: You are fully responsible for any fines, fees, penalties, and any other charges incurred as a result of improper parking or violation of any law or regulation while using our Services. This may include, but is not limited to, unauthorized parking, traffic violations, and towing fees.

3. Safety

Safety Check: Before each use of a Scooter, you shall conduct a basic safety inspection of the Scooter, which includes inspecting the following: (i) proper tire pressure; (ii) safe operation of all brakes and lights; (iii) good condition of the frame; (iv) sufficient battery charge power; and (v) any sign of damage, unusual or excessive wear, or other open and obvious mechanical problem/maintenance need. You agree not to ride the Scooter if there are any noticeable issues, and to immediately notify customer service to alert UrbanGlide of any problems.

Helmets; Safety: We strongly recommend that you wear a Snell, CPSC, ANSI or ASTM approved helmet that has been properly sized, fitted and fastened according to the manufacturer’s instructions. Wearing a helmet is not a guarantee against personal injury. You assume all risk of not wearing a helmet or other protective gear.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, URBANGLIDE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF. URBANGLIDE MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS.

YOU AGREE TO RELEASE, INDEMNIFY, AND HOLD URBANGLIDE HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, DISPUTES, DEMANDS, LIABILITIES, DAMAGES, LOSSES, AND COSTS AND EXPENSES.

5. Termination

We may, in our sole discretion, without penalty, and at any time, terminate your right to use the Services. If you wish to terminate this Agreement, you may do so by ceasing to use the Services and deleting the App from your device.
